Connected surveillance cameras allow users to keep tabs on their homes while they are away. But these private facilities require installation in accordance with the law. Current legislation imposes a framework for the installation of indoor or outdoor cameras.
Indeed, only the property (interior and exterior) of an individual can be filmed. It is forbidden to capture images of the public road or of a neighbor's property even if one wishes to monitor one's own vehicle parked in front of the house, for example. If the configuration of the accommodation makes it impossible to avoid the public road, it is preferable to contact the Prefecture before any installation. Conversely, if all the conditions are met, no declaration from the Prefecture is required for the installation of a private camera.

Always prevent
It is imperative to inform anyone who can be filmed of the presence of a camera. If they are members of the same family, respect for private life prevails. In the event that the latter is not respected, the victim has the right to initiate proceedings against the person who installed the camera.
For guests or employees working at home (childcare or caregiver, for example), it is also mandatory to notify them. In addition, the purpose of this monitoring must be specified, either by clearly displaying it at the entrance to the space concerned, or by specifying it in the employee's contract.
If minors, outside the family circle, are required to be filmed, it is the parents who must be made aware of the system in place.
In the context of a rental, the owner is also obliged to warn the tenants that a video surveillance system is in place; again, respect for private life applies.
The results
If all of the above conditions are met, the owner can view the images and save them. But be careful, he cannot use it as he wishes. As a reminder, according to the Penal Code “is punishable by one year of imprisonment and a fine of € 45 for the fact, by means of any process, of willfully violating the privacy of the private life of others ”. This is applicable if the videos were captured, recorded and transmitted without the consent of the person in question, in a private or confidential setting. Likewise, it is possible to initiate proceedings if the location of the individual has been disclosed (in real time or not) without his consent.
If it is a spouse, a cohabiting partner or a partner bound by civil act who is at the origin of the facts, the penalty incurred is up to 2 years imprisonment and a fine of € 60.
